Our website is hosted through Shopify, which provides the e-commerce platform that allows us to sell our products online.

By using our website or purchasing from Lore & Whimsy, you agree to comply with these Terms as well as our other applicable policies, including our:

2. Using the Lore & Whimsy Website

You are responsible for providing accurate information when placing an order, creating an account, or otherwise communicating with us.

3. Products & Product Information

We make reasonable efforts to ensure that product descriptions, photographs, colors, dimensions, and other product information are accurate.

However, colors and other visual details may appear differently depending on your device, monitor, or screen settings. Minor variations between product photographs and the actual product may occur.

Some products may be available only in limited quantities or for a limited time. We may discontinue products or collections at any time.

If a product is damaged, defective, or materially different from its description, please contact us in accordance with our Return & Refund Policy.

Purchasing a product from Lore & Whimsy does not transfer ownership of any intellectual property associated with that product. See Section 8 — Intellectual Property & Licensing for more information.

4. Pricing, Promotions & Availability

All prices displayed on loreandwhimsy.com are listed in U.S. dollars unless otherwise stated. Prices are subject to change at any time without notice.

The price charged for an order will be the price displayed at the time the order is placed, except in cases of an obvious pricing or listing error.

We occasionally offer sales, promotions, discount codes, newsletter offers, rep codes, and other promotional opportunities. Each promotion may have its own terms, eligibility requirements, expiration dates, exclusions, or other restrictions.

Discount codes cannot be applied retroactively to orders that have already been placed. Please make sure your discount code has been successfully applied before completing your purchase.

Discount codes generally cannot be combined unless a specific promotion states otherwise. Please review the terms of each promotion to determine whether multiple offers can be used together.

We reserve the right to modify, extend, suspend, or end a promotion at any time, subject to any terms that apply to the specific promotion.

We make every effort to display accurate pricing and product availability. If an item is accidentally listed at an incorrect price or with incorrect information due to a typographical, technical, or other error, we reserve the right to correct the error and, where appropriate, cancel an affected order and refund any amount paid.

We may limit the quantity of products that any customer may purchase, particularly for limited-edition products, promotional items, or products subject to limited availability.

5. Orders & Payments

When you place an order through loreandwhimsy.com, you are making an offer to purchase the products in your order. Your order is subject to acceptance and availability.

After placing an order, you will receive an order confirmation email acknowledging that we have received your order. This confirmation does not necessarily mean that your order has been accepted or that the products are guaranteed to be available.

We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including when:

  • A product is unavailable;
  • We identify an obvious pricing or listing error;
  • We suspect fraudulent or unauthorized activity;
  • An order appears to be placed for unauthorized resale or in violation of a stated quantity limit;
  • The information provided for the order is inaccurate or incomplete;
  • We are unable to process the payment; or
  • Circumstances outside of our reasonable control prevent us from fulfilling the order.

If we cancel an order after payment has been received, any amount paid for the cancelled portion of the order will be refunded to the original payment method.

You are responsible for providing accurate and complete billing, shipping, and contact information when placing an order. Please review your information carefully before completing your purchase.

If you need to change your order, please contact help@loreandwhimsy.com as soon as possible. Orders may be changed or cancelled within 24 hours of being placed, subject to the terms of our Cancellation Policy.

Once an order has been marked as shipped or has begun fulfillment, we cannot guarantee that changes or cancellations can be made.

Preorders cannot be cancelled.

Payment must be successfully authorized and received before an order can be processed. By placing an order, you confirm that you are authorized to use the payment method provided.

You agree not to use a fraudulent, unauthorized, or otherwise invalid payment method when placing an order.

6. Shipping, Returns & Cancellations

Orders placed through Lore & Whimsy are subject to our Shipping Policy, Return & Refund Policy, and Cancellation Policy.

Please review these policies before placing an order, as they contain important information about processing times, shipping, cancellations, returns, refunds, damaged or defective products, lost packages, and returned or undeliverable orders.

By placing an order, you acknowledge and agree to the terms of these policies.

Shipping and processing times vary depending on the type of product purchased. In-stock items, made-to-order items, and preorders may have different processing timelines. Applicable processing and estimated fulfillment information will be provided on the relevant product page and/or in our Shipping Policy.

Once an order has been shipped, delivery is handled by the applicable shipping carrier. Lore & Whimsy is not responsible for delays, missed delivery estimates, or other circumstances caused by the carrier or events outside our reasonable control.

Nothing in our Shipping Policy or Return & Refund Policy limits any rights or remedies you may have under applicable law.

7. Preorders & Made-to-Order Products

Some Lore & Whimsy products are offered as preorders or made-to-order items. These products are created or obtained specifically for customer orders and may require additional time before they can be shipped.

Preorders

Preorder products will have an estimated fulfillment or shipping timeframe listed on their product page at the time of purchase.

Preorder timelines are estimates and may change due to circumstances such as production delays, supplier delays, shipping delays, or other circumstances outside of our reasonable control.

If there is a significant change to the expected fulfillment timeframe, we will provide an update when reasonably possible.

Preorders cannot be cancelled once an order has been placed, except where required by applicable law.

Made-to-Order Products

Made-to-order products are created specifically for your order and typically ship within 4–6 weeks after the order is placed.

Because these products are made specifically for the customer, they cannot be cancelled or returned simply because the customer changes their mind.

If a made-to-order item arrives damaged or defective, please contact us in accordance with our Return & Refund Policy.

Orders Containing Multiple Product Types

If an order contains a combination of in-stock, made-to-order, or preorder products, the entire order will be held and shipped together once all items are available, unless otherwise stated.

For example, if an order contains an in-stock item and a preorder, the in-stock item will not ship separately. The order will ship once the preorder is ready.

If you would like an in-stock item sooner, we recommend placing a separate order for that item.

8. Intellectual Property & Licensing

All content on the Lore & Whimsy website, including but not limited to product designs, artwork, graphics, photographs, logos, branding, written content, illustrations, product descriptions, and website design, is owned by Lore & Whimsy, its licensors, or the applicable rights holders, unless otherwise stated.

Lore & Whimsy Designs

Original designs created by Lore & Whimsy are protected by applicable intellectual property laws. Purchasing a product from Lore & Whimsy does not transfer ownership or intellectual property rights in the design to the purchaser.

You may use products you purchase for your own personal, non-commercial purposes. You may not reproduce, copy, modify, redistribute, manufacture, sell, or commercially exploit Lore & Whimsy designs without prior written permission.

This includes using our designs or artwork to create your own products, merchandise, digital files, or promotional materials.

Commissioned Artwork

Some Lore & Whimsy products may feature artwork created by independent artists commissioned by Lore & Whimsy.

The rights to commissioned artwork are governed by the applicable agreement between Lore & Whimsy and the artist. Purchasing a product featuring commissioned artwork does not grant the purchaser any additional rights to reproduce, modify, distribute, or commercially use that artwork.

Licensed Intellectual Property

Some Lore & Whimsy products are inspired by, based on, or related to existing books, characters, stories, or other intellectual property owned by third parties.

Where applicable, these products are officially licensed by the relevant rights holder.

Lore & Whimsy does not claim ownership of the underlying intellectual property belonging to authors, publishers, studios, or other rights holders. Any trademarks, characters, names, logos, or other intellectual property belonging to third parties remain the property of their respective owners.

Our licensed products are produced and sold pursuant to the permissions and licensing rights granted by the applicable rights holder.

Website Content

The Lore & Whimsy name, logo, branding, website content, photographs, graphics, product descriptions, and other original materials may not be copied, reproduced, republished, distributed, or commercially used without prior written permission, except where permitted by applicable law.

Nothing in these Terms grants you a license or other right to use Lore & Whimsy's intellectual property or the intellectual property of any third party beyond the personal use of products you have lawfully purchased.

9. Customer Content & Reviews

We love seeing Lore & Whimsy products in their new homes! Customers may choose to submit reviews, photographs, testimonials, comments, or other content about their experience with Lore & Whimsy (“Customer Content”).

By submitting Customer Content directly to Lore & Whimsy, including through our website, email, or other channels where submission is clearly intended for use by Lore & Whimsy, you confirm that:

  • You created the content or have permission from the person who created it to submit it;
  • Your submission does not knowingly violate another person's intellectual property, privacy, or other rights; and
  • The content does not contain unlawful, threatening, abusive, defamatory, or otherwise inappropriate material.

By submitting Customer Content, you grant Lore & Whimsy a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and share that specific content for purposes related to operating and promoting Lore & Whimsy.

This may include displaying customer reviews on our website, sharing customer photographs on our social media accounts, featuring testimonials in marketing materials, or otherwise showcasing your experience with our products.

We will not claim ownership of your Customer Content simply because you have submitted it to us.

If you tag Lore & Whimsy in a public social media post, we may ask for permission to repost or use that content. A public post or tag does not automatically mean that you have granted us permission to use the content for advertising or other commercial purposes.

We reserve the right to remove or decline to publish Customer Content that we believe violates these Terms, applicable law, or the rights of others.

Lore & Whimsy is not responsible for the actions, policies, content, availability, or performance of third-party websites, services, or providers that we do not control.
